Small Site Erosion Control Instructions

Erosion and sediment control for development projects is required and described in Bend Municipal Code Title 16.35 Erosion Control Requirements.

Why? These requirements are in place to protect surface and groundwater quality in Bend during development projects and are mandated by the Oregon Department of Environmental Quality through the City of Bend’s municipal stormwater permit. City code was updated in August of 2024 to include smaller developments to meet new regulations.

The City of Bend has developed small project erosion and sediment control requirements to simplify the process for small residential projects. This includes an erosion control template provided as part of the building permit package. In addition to the template, a building permit condition submittal will be required for small residential developments on lots greater than or equal to 5,000 square feet*. The condition requirements must be met prior to requesting building inspections.

*For projects using the City’s Residential Land Divisions Early Actions Program, the requirements are applied to building permits associated with residential units where the platted lot is greater than or equal to 5,000 square feet at the time of application. If individual lots have not yet been officially platted and recorded, and the original property is 5,000 square feet or larger, the lots will have the new erosion control requirement applied.

Small Project Erosion and Sediment Control Condition Requirements

Instructions for Condition Submittal:

Step 1: Best Management Practices

Install the following three erosion and sediment control best management practices (BMPs) on your project site per the signed erosion and sediment control template (1-4 units). For installation guidance please refer to the guidance videos and the stormwater standard drawings for erosion.

• Best Management Practices #1; Perimeter Control: Physical sediment barrier at the project perimeter, downslope of disturbed areas. Can include wattles, subgrade barrier, or sediment fence. See standard drawings E-1, E-9, and E-4.
• Best Management Practices #2; Inlet Protection: Prefabricated sediment filtration for curb and grated inlets/catch basins adjacent to the project site. See standard drawings E-2A, E-2B, and E-2C.
• Best Management Practices #3; Construction Entrance: Open graded rock placed at the designated construction access point to stop sediment transfer into the right of way. See standard drawing E-8.
• Fourth Photo; Site Identification: The fourth photo must include a picture of the lot including site identification (building permit # or address and lot number) of the project on written paper.

Step 2: Photos

Take 1 photograph for each of the installed best management practices on your project site. Upload the photos to the condition for City review. *A fourth photo must include site identification (building permit # or address and lot number) and of project on written paper).

Step 3: Review/Approval

City staff will digitally review submitted photos for accuracy and approval.

After condition approval: After your submitted photos have been reviewed and condition resolved you may proceed with scheduling other building inspections. At the end of your project, the Small Site Erosion Control Final inspection will be conducted onsite to verify the project is fully stabilized and all temporary best management practices have been removed. City staff may perform additional or complaint driven inspections when necessary. Please continue to maintain all Best Management Practices installed under this condition as well as those identified on the signed template throughout the life of your project.
