Juniper Ridge Area Removal and Cleanup Implementation Plan

The City of Bend (“City”) is committed to the safety and security of all residents, including property owners and people experiencing homelessness, while protecting all residents from unsafe and dangerous conditions. Therefore, the City has developed this Removal and Cleanup Implementation Plan (the “Plan”) to carry out the City’s Public Land Management Policy for Juniper Ridge, relating to the prioritized and organized removal process of established campsites at Juniper Ridge.  “Prioritized” means cleanup and removal efforts that are based on imminent unsafe and hazardous conditions within the Construction Zone.

This Plan outlines the administrative process by which the City will remove established campsites from city-owned property based on a priority level from an area previously identified as the “Construction Zone,” and shown on the map at the end of this document.  “Construction Zone” indicates an area or location within Juniper Ridge where imminent construction of the North Interceptor Sewer Line Project will pose unsafe and hazardous conditions to the established campsites, and campsites will pose an obstruction. “Obstruction” means people, tents, personal property, garbage, debris or other objects related to an campsite that interfere with the construction of the North Interceptor Sewer Line Project and other development activities.

Outreach Efforts

The City will partner with community service providers to coordinate outreach efforts prior and during all organized removal efforts.  City representatives will continue to offer outreach and referral to existing shelter options as identified and requested by individuals in Juniper Ridge.  Additionally, the City will continue to allow outreach workers to visit the campsites where a notice has been posted to assess the need for social service assistance in arranging shelter and other services, until the areas is closed to all unauthorized access when construction begins, approximately April 20, 2020. 

The City will convene regular meetings with community service providers to gather feedback on identified needs of individuals in Juniper Ridge, assess local resources to address the identified gaps, assist in coordinating service delivery (may include a Mobile Service Center or other identified needs), and provide funding within the scope of the City’s budget for critical resources as determined by the service providers and the City.    

Notice to Vacate

The City will provide notice of when removal and cleanup efforts will begin on the week of February 18, 2020 by posting written notice in English and Spanish at each identified established campsite approximately 60 and 30 days, and 24 hours prior to all organized outreach, removal, and cleanup efforts.  The notice will include the date it was posted, the campsite number, contact information for social service resources, and information on how to retrieve stored personal property. 

Reasonable Accommodations

All notices will include City staff information as the point of contact and how an individual with a disability may request:

  1. The notice or other information provided in an alternate format (Large print, Braille, electronic format, etc.); and/or
  2. A reasonable accommodation for the removal, relocation, and cleanup policy.

Upon requests for either alternative formats or reasonable accommodation requests, City staff will engage the City’s Accessibility Manager to initiate accommodation analysis.  Per Title II of the Americans with Disabilities Act, no qualified individual with a disability shall, on the basis of disability, be excluded from participation in or be denied the benefits of the services, programs, or activities of a public entity.  If an individual with a disability feels that the City has failed to comply with Title II of the ADA/Section 504 of the Rehabilitation Act, they may submit a discrimination complaint, or grievance with the City’s Accessibility Program. Campsite Removal and Cleanup Efforts

City representatives will offer to store belongings for those on site during outreach efforts and during the time range when the cleanup will occur.  During all removal and cleanup efforts, all personal belongings collected will be inventoried and photographed whether or not the individual is present, and stored for a maximum of 30 calendar days from when the items were removed from the campsite.  Clearly abandoned and/or hazardous items will be immediately discarded.  A notice will be posted at the site where a campsite has been removed and the site cleaned.  This notice will state the date the cleanup occurred, whether personal property was stored and how it can be claimed by the owner, and contact information for shelter alternatives and other services.

Cleanup Efforts

 

The City will coordinate multiple cleanup and removal efforts of illegally dumped trash, abandoned items, and/or hazardous materials prior to, during, and after all cleanup and removal efforts of campsites.  No notice will be given prior to removal of abandoned or illegally dumped personal property that is not associated with an established campsite.  The City will make reasonable efforts to determine whether personal property is associated with an established campsite, including neighboring campsites, or checking City information about whether a campsite was previously identified at the location.

Campsite Removal

City representatives asking individuals to move within 24-hour notice period will attempt to provide additional services or connect the individual to services that can facilitate the person’s movement from the campsite and out of the Construction Zone. Towing services, packing assistance, and other resources will continue to be offered even after a 24-hour notice has been provided. After all described activities have been deployed, including the 24-hour notice, those remaining unlawfully may be subject to arrest for Criminal Trespass II (ORS 164.245). 

  • Removal of Personal Property – personal property will be properly inventoried, boxed, bagged, and tagged with the campsite number by an environmental contractor in coordination with City staff and public safety.Weapons, drug paraphernalia and items that appear to be either stolen or evidence of a crime will be given to law enforcement officials. 
  • Storage of Personal Property – personal property will be stored and secured in storage containers located onsite at the end of Cooley Road for up to 30 calendar days. 
  • Retrieval of Personal Property – personal property may be retrieved by contacting the City’s Property Manager at 541.323.5997 to schedule an appointment between the hours 8:00AM – 5:00PM, Monday thru Friday. 
  • Unclaimed Personal Property – all unclaimed personal property after the storage period will be considered trash and discarded by City staff accordingly. 
  • Removal of Motor Vehicles – all abandoned vehicles will be photographed and inventoried prior to removal, and stored onsite near the end of East Cooley Road for a maximum period of 30 calendar days. 
  • Retrieval of Personal Vehicles – personal property may be retrieved by contacting the City’s Property Manager at 541.323.5997 to schedule an appointment between the hours 8:00AM – 5:00PM, Monday thru Friday. 
  • Unclaimed Motor Vehicles – all unclaimed vehicles will be processed and disposed of by Consolidated Towing after 30 calendar days pursuant to ORS 98.830. 
  • Release of Liability – the City does not take responsibility for lost, missing, stolen or damaged personal property during the removal process or storage period. 
  • Road Side Assistance – light and heavy towing, recovery, and roadside assistance of motor vehicles from the Juniper Ridge area will be available to registered vehicle owners to a destination outside of the Juniper Ridge area within a 15-mile radius at no cost Monday thru Friday between the hours of 8:00AM – 5:00PM by contacting the City’s Property Manager at 541.323.5997.If a vehicle will be towed to private property, vehicles owners must demonstrate permission of the property owner to relocate the vehicle there.

Priority – although the Policy and Plan will be applicable to all 1,500 acres of City-owned property at Juniper Ridge, the City’s priority is to implement the Plan within the Construction Zone first.

Monitoring – City staff, Bend Police, Deschutes County Sheriff, and Bend Fire and Rescue will continue to monitor all 1,500 acres.

New Campsites – the City will conduct regular inspections of the area for new campsites identified after the initial 60-day notice was issued.  Any new campsites established after February 18, 2020, will receive a 24-hour notice to vacate the area.

Contract Services – the City will be contracting services for the storage of personal property, the rental of garbage containers, removal of inoperable motor vehicles, and other services as deemed necessary.

Sequence of Events

Week of February 18, 2020 – Beginning of 60-Day Notification Process

Notices printed in English and Spanish of outreach, removal, and cleanup efforts will be posted at every identified established campsite within approximately one week of February 18, 2020. Outreach efforts will include providing referrals to existing shelter options and other services, and will coordinate efforts with social service providers to conduct site visits. The City will provide in-person meetings with community service agencies and/or notify by email updates about the notification period process. 

Cleanup and removal efforts of items including illegally dumped trash, abandoned items, and/or hazardous materials will be ongoing.

City representatives and social service providers may offer items to facilitate cleanup and packing efforts of personal items.

Week of March 16, 2020 – Beginning of 30-Day Notification Process

Notices printed in English and Spanish of outreach, removal, and cleanup efforts will be posted at every identified established campsite within approximately one week of March 16, 2020. Outreach efforts will include providing referrals to existing shelter options and other services, and will coordinate efforts with social service providers to conduct site visits and/or discuss ways to support individuals in accessing services and moving from Juniper Ridge. The City will provide in-person meetings with community service agencies and/or notify by email updates about the notification period process. 

Cleanup and removal efforts of items including illegally dumped trash, abandoned items, and/or hazardous materials will be ongoing.

City representatives and community service agencies may offer items to facilitate cleanup and packing efforts of personal items.

April 13, 2020 – Posting of 24-Hour Notices and Removal Efforts

 

Notices printed in English and Spanish of outreach, removal, and cleanup efforts will be posted at every identified established campsite within approximately one week of April 13, 2020.

Prior to removing homeless individuals from an established camping site, City representatives shall post a notice to vacate, written in English and Spanish, 24 hours in advance.

The City will provide in-person meetings with community service agencies and/or notify by email updates about the 24-hour notification period process.  The City will continue to allow community service agencies to enter Juniper Ridge where a notice has been posted to assess individuals’ needs and arrange for shelter and other critical assistance. 

All unclaimed personal property from an established campsite where 24-hour notice was posted shall be given to law enforcement officials. The property will be stored for a minimum of 30 days during which it will be reasonably available to any individual claiming ownership. The City will dispose of any personal property that remains unclaimed for 30 days. Personal property is statutorily defined as any item “that is reasonably recognizable as belonging to a person and that has apparent utility. Items that have no apparent utility or are in an insanitary condition may be immediately discarded upon removal of the homeless individuals from the camping site.”

Notices of outreach, removal and cleanup efforts will be posted at every identified established campsite.  The City will also notify social service providers and other public agencies. Outreach efforts will include notifyig individuals of alternate shelter options and other services, and will coordinate efforts with social service providers to conduct site visits.

Cleanup and removal efforts of items clearly refused, illegally dumped trash, abandoned of no apparent use or in unsanitary condition and/or hazardous materials will be ongoing.

City representatives and community service agencies may provide supplies such as, but not limited to, plastic bags, boxes, and other items to facilitate all cleanup and packing efforts of personal items.

April 20, 2020 – December 31, 2022 – Public Land Management Best Practices

 

The City will convene a meeting after April 20, 2020 with community service providers and those working directly with individuals in and around Juniper Ridge to assess this plan, the notice and removal policy, and to discuss any recommended changes needed for potential future removal efforts.

The Construction Zone will be closed to all unauthorized access for the duration of the construction project.

City staff and/or its representatives will continue to monitor the area periodically.  Any new camps identified within the Juniper Ridge Construction Zone during this period will receive a 24-hour notice to vacate the area. City staff will notify social service agencies at the time 24-hour notice is posted, and will allow representatives of the social service agencies to visit the campsite where notice has been posted. Provisions of this policy for removing and storing personal property will be followed after the 24-hour period has expired.

Construction signs will be posted around the property stating that access is limited to authorized personnel only.

Vehicular entry points will be secured and gates locked accessible to public safety and authorized personnel only.

The City will continue periodic inspections for residual and illegally dumped trash, and will remove trash and other debris not associated with any established campsite.

Fuel abatement efforts will be implemented.
